Terms and Conditions

These terms and conditions help to keep data-pro.co.uk a safe place to trade and sets out an agreement reached between you and Data Pro in connection with this site. You should understand that by placing an order, you accept the following terms and conditions:

  1. Your contract for purchases made through this web site is with Data Pro
  2. You agree that e-mail can be used as a means of communication.
  3. No contract for the sale of any product will subsist between you and Data Pro unless and until Data Pro accepts your order by e-mail confirming that it has received payment in full for all the goods you have ordered. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Data Pro sends the e-mail to you (whether or not you receive that e-mail). This confirmation e-mail amounts to an acceptance by Data Pro of your offer to buy goods from Data Pro.
  4. This confirmatory e-mail will contain all relevant statutory information concerning your contract.
  5. You must check that the details on this confirmatory e-mail are correct as soon as possible and it is recommended that you print out and keep a copy of it.
  6. Data Pro will not pass on your personal or credit or debit card details to any third party.
  7. You undertake that all details you provide to Data Pro for the purpose of ordering or purchasing goods or services are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the goods or services ordered.
  8. If there are any changes to the details supplied by you it is your responsibility to inform Data Pro as soon as possible.
  9. Your statutory rights are not affected (in particular see below as to your rights to withdraw from the contract) but otherwise all purchases are non-exchangeable, non-refundable and non-transferable.

Liability

  1. Data Pro attempts to ensure that the information available on the website at any time is truthful and accurate. However, Data Pro assumes no duty to update such information and Data Pro cannot guarantee that it will be correct.
  2. Data Pro does not accept liability (except as set out below) for any errors and omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services.
  3. Data Pro will do its best to correct errors and omissions as quickly as practicable after being notified of them.
  4. In the unlikely event that you receive goods which were not what you ordered or which are damaged or defective, or are of a different quantity to that stated on your order form, Data Pro shall make good any shortage or non-delivery, replace or repair any damaged or defective goods, or refund to you the amount you paid for the goods in question PROVIDED THAT you notify Data Pro of the problem within 10 working days of delivery of the goods. NOTHING IN THIS CLAUSE AFFECTS YOUR STATUTORY RIGHTS.
  5. Data Pro do not accept liability for:- a) For losses that were not foreseeable to both parties when the contract was made. b) For losses that were not caused by any breach on the part of Data Pro. c) For business losses and/or losses to non consumerers

Processing of orders

  1. Credit and Debit cards are debited by SagePay before items are shipped. All prices include sales taxes (where applicable) unless otherwise stated.
  2. Every purchase you make shall be deemed performed in the United Kingdom. UK law shall govern every aspect of contractual agreement concerning purchases made from this web site.
  3. Data Pro aim to arrange shipment of all in stock items within 5 days of receiving your order. Your order may be delayed if the item is not in stock. You may cancel your order at this stage by emailing us via the form on the Contact us link. However, please allow 14 days for delivery as we will not deal with any delivery enquiries before this time has elapsed.

Delivery/Title/Risk

  1. Any delivery period stated is approximate. IMPORTANT: The place of delivery will be the address on file at the time of dispatch and not when ordered. Delivery may be made in instalments.
  2. Confirmation of order does not represent a legally binding contract. Should Data Pro be unable to complete the order, you will be notified and your money will be refunded.
  3. Title to any product ordered will pass to you once Data Pro has received payment in full for that product.

Payment & Site Security

  1. SagePay provides a cost-effective mechanism which allows Data Pro customers to securely pay for goods and services or complete subscriptions ordered from our web site. The security and privacy of all card details are maintained by SagePay. High levels of encryption, (SSL, 128-bit encryption, the highest level of protection possible and AVS - Address Verification Service) transactions are authorised within seconds.
  2. SagePay is a secure, online, real-time payment service provider, supporting all major credit and debit cards with the (major) UK acquiring banks for Visa, Mastercard, Switch, Solo, Delta, JCB, American Express and Diners Club.

Reviews, comments, communications and other content

  1. Users of this website may post reviews, comments and other content; send communications; and submit suggestions, ideas, comments, questions, or other information, as long as the content is not illegal, obscene, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any content. Data Pro reserves the right (but not the obligation) to remove or edit any content.

Miscellaneous

  1. It is a crime to use a false name or a known invalid credit card to order. Anyone caught wilfully entering an erroneous or fictitious order will be prosecuted to the fullest extent of the law. Data Pro tracks the electronic fingerprints of every order placed on data-pro.co.uk to enable us and all legitimate crime prevention and prosecution authorities to trace individual users engaging in criminal activities on our website.
  2. If you do not wish to be bound by these terms and conditions and/or you have changed your mind about your purchase, please click the "Cancel Order" button on our shopping cart.
